Action by plaintiff Fred Lundquist against defendants Genevieve Lewerenz (hereinafter defendant) and the Western Casualty
& Surety Company, her insurance carrier, to recover damages for personal injuries and damage to property sustained in
an automobile accident. The accident occurred at the intersection of Highway 13 and McMillan street in rural Wood county north of Marshfield at about
4:30 p. m. on December 2, 1963. At this point Highway 13 runs in a generally northerly and southerly direction and is an arterial
highway. The intersection is in the shape of a Y in that McMillan street branches off from Highway 13 in a sweeping curve
to the southeast. One hundred seventy-nine feet to the north of this intersection is a T-shaped right angle intersection where
Lincoln avenue extends westward from Highway 13. Plaintiff was driving his automobile in a southerly direction on Highway
13 and defendant was operating her car easterly on Lincoln avenue, intending to enter Highway 13 and then exit onto McMillan
street. Defendant stopped for the arterial stop sign before entering Highway 13 and then turned south or southeasterly onto
that highway at a time when plaintiff's car was approaching from the north. Plaintiff, in order to avoid striking defendant's
car, turned to the left and attempted to proceed up McMillan street, but lost control of his vehicle with the result that
it crashed into a utility pole on the south side of McMillan street approximately 154 feet from its intersection with Highway
13. Plaintiff sustained injuries as a result of the accident.
